Does anyone own the intellectual copyright to the card game TRUMPS? I have an idea for a great Trumps game….
I have a great idea for a Trumps card game based on something my kids really enjoy. I have made up a pack of Trump cards at home and I think there would be a market for these. Can I market it myself or is it better to approach the company who market “Top Trumps”? Do they have intellectual copyright over the “Trumps” concept? Surely as this is just a comparison card game they cannot claim copyright over it? I would not be marketing the game under the name “Trumps”….
You would be very unwise to market a game even similar to another game without checking out all the IP rights. The company owning the Trumps trademarks could still sue you for passing off, if they can prove that people are buying your product believeing it to be a Top Trumps product, even if the packaging, style, logos etc. are markedly different.
