Illegal business practice, Independent Contractor instead of employee?
I work “for” a company that considers almost all of it’s workers independent contractors. I looked on the IRS website, and I believe they are breaking some IRS rules with this. It is a Tech Support company. Basically, I work from home and get paid strictly commission, and can work whenever I want to, for however long I want to. HOWEVER, they provide us with training, and we have to follow strict guidelines for how to do our job. On the IRS website it states that an employer cannot consider someone an independent contractor if the contractor is told how to do their work, and what tools to use. We, however, are given STRICT guidelines to follow and we are only allowed to use a few tools they supply to us. It also states that a strong sign of being an employee, not a contractor, is when the employer gives the employee training, which we receive as independent contractors. My question is, is what the company I do business for does illegal? And if so, what can I do about it?
Sounds legal to me. talk to your state labor department.
Keeping in mind they can probably fire you rather than hire you.
